Workshop Overview

In this two-day workshop, the course facilitator aims to teach the participants the important points relating to the management of cargo claims and recovery with the view to encouraging participants to adopt a systematic approach to handling cargo claims or defending cargo claims. The workshop will touch on important areas of consideration for handling cargo claims as well as the defence of cargo claims.

He will also highlight the issues that need to be considered and the steps that need to be taken. The workshop will also highlight issues of bill of lading and conventions and rules governing contracts of carriage which may impact on cargo claims. The course will be taught from the different perspectives of a claimant as well as a defendant or carrier or insurance company subrogated to their rights of the claim from defendants.

We will have a guest speaker on Day 2 (Afternoon session) who will be sharing his experience on the aspects of Insurance with regards to Cargo Claims.


 

Faciliator Profile

The course facilitator is a shipping lawyer and a partner of a boutique shipping law firm. He read law at the University of Nottingham before qualifying as a barrister in London and as an advocate and solicitor in an English law firm and read his Masters in Maritime Law at the University of Southamptom as an inaugural Joint Maritime Scholar with the Maritime and Port Authority of Singapore on a scholarship given to working professionals in the maritime industry in Singapore.

Since he started his legal career, he has practiced largely in the area of shipping and logistics. His practice stretches across the entire spectrum of contentious and non-contentious shipping work. He believes that this benefits his clients when he advises them. He advises shipping companies and freight forwarders on all legal matters concerning their businesses. He regularly acts for clients in shipping cases before the Singapore courts and also in international maritime arbitration claims.

Our facilitator has taught and spoken regularly on various shipping law subjects in conferences and courses organized by various shipping related institutions in Singapore, Malaysia and Indonesia. In 2005, he was invited by the Indonesian Directorate General of Sea Transportation (DGST) and Indonesian Shipowners Association to speak on international ship arrest law. He is a lecturer on legal subjects for logistics diploma courses for working professionals organized by the Singapore Logistics Association (SLA). He is on the editorial panel for the UK Informa Maritime course on “An Introduction to Admiralty Law and Practice” and wrote the chapter on English ship arrest law.

His clients come from Singapore, Indonesia, Malaysia, Vietnam, Turkey, Spain, United Kingdom, China, Australia, Holland, Panama, Croatia and South Korea.


About your guest speaker

The speaker is the head of the Transport and Trade team of his law firm. This practice covers all areas of transport and trade law, and is underpinned by the speaker’s extensive experience in shipping and international trade. For 30 years, he has advised on all aspects of international transport and trade, including disputes, transactions and a broad range of contractual and regulatory matters. His work in this area includes advising on disputes involving:
  • Charterparties, contracts of affreightment and bills of lading
  • Ship arrests and judicial sale
  • Cargo recoveries, including cargo contamination
  • Ship building and repair
  • Collisions, crashes and derailments
  • Vessel detention and seizure
  • Oil and Gas facilities and projects


The speaker is also the former chairman of the New South Wales branch of Maritime Law Association of Australia and New Zealand and is the immediate past chairman of Maritime and Land Transport Law Committee of the International Bar Association.

He regularly contributes to publications and addresses industry groups. He is listed in Euromoney’s Guide to the World’s Leading Shipping and Marine Lawyers and is on the editorial board of Maritime Risk International. He was one of only 13 Australians named in the 2009 and 2007 editions of the International Who’s Who of Shipping and Maritime Lawyers. He has also been named in previous International Who’s Who lists while a partner of another national firm.

He is an active member of the International Bar Association, the United States Maritime Law Association, the Chartered Institute for Logistics and Transport, the Australian Institute of Export, the Food and Beverage Importers Association of Australia, the Marine and Transport and the Reinsurance NSW discussion groups (Institute of Insurance) and the Average Adjusters Association (London).
